Welcome to The Modern Bride ("TMB," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your use of our website tmodernbride.com and any appointments, purchases, or services with our bridal boutique in Guelph, Ontario. By using our website or booking an appointment, you agree to these Terms. Please read them carefully.

1. About Us

The Modern Bride is an appointment-only bridal boutique carrying designers including Alena Leena, MWL, Sarah Seven, Mikaella, Paloma Blanca, Pronovias, Katherine Tash, VARCA, and Eden Aharon.

2. Use of Our Website

You agree to use our website only for lawful purposes. You may not:

  • Use the site in any way that could damage, disable, or impair its functionality

  • Attempt to gain unauthorized access to any part of the site or its systems

  • Use automated tools (bots, scrapers) to extract content without our written permission

  • Post or transmit any unlawful, harmful, or infringing material through the site

We reserve the right to restrict or terminate your access to the site at our discretion.

3. Appointments & Bookings

  • Bridal Appointments have a booking fee as disclosed at the time of booking; fees are subject to change.

  • Bridal appointment fees are credited to the purchase of your dress if purchased at your initial appointment.

  • Appointments are by booking only, through our website or by contacting us directly.

  • Walk-ins are accepted if staffing is available but not guaranteed.

  • We ask that you arrive on time; late arrivals may result in a shortened appointment to respect the next client's booking.

  • We reserve the right to limit the number of guests attending an appointment, at our discretion, based on space and boutique policy.

  • We do not allow pets or animals inside the boutique, with the exception of service animals as defined under the Accessibility for Ontarians with Disabilities Act (AODA) and the Ontario Human Rights Code.

  • To respect your experience, we ask that small children stay home with loved ones. Infants in carriers are allowed.

Cancellations & Rescheduling

Appointments may be rescheduled or cancelled 48 hours prior to your appointment time at no charge. Appointments cancelled within 48 hours will not be refunded. There is no charge for One Last Look, Dress Arrival, and Styling appointments, but a no-show fee is applicable.

4. Orders, Payment & Pricing

  • All prices listed in-store or on our website are in Canadian dollars (CAD) unless otherwise noted, and are subject to change without notice. Any quoted, tagged, or listed pricing is not inclusive of HST. Quoted prices are valid for 30 days. After 30 days the pricing is reflective of the store listed price. 

  • Alteration services are separate from TMB services. We have a list of recommended seamstresses, but you are not required to use these recommendations. All dresses will require alterations; any alterations needed are billed separately and quoted separately.

  • We accept VISA, MASTERCARD, AMEX, INTERAC, INTERAC e-transfer, cash, or cheque.

Deposits

We require a 60% deposit on new special order gown purchases. Accessory special orders and dress samples require payment in full upon purchase.

Balances

Upon notification of your gown's arrival, the remaining balance is due and the gown must be picked up within 30 days.

If you are unable to pick up your gown in person, a shipping or pick-up release form must be signed prior to release. Pick-up and shipping arrangements must be finalized during this 30-day timeframe. After 30 days, a monthly storage fee of $100/month will apply.

Order Cancellations & Returns

All purchases are final sale upon signing our sales agreement and payment has been made. No returns, refunds, or exchanges can be made, no exceptions.

5. Communications and Privacy

Communications

Service & Transactional Communications By booking an appointment or making a purchase, you agree to receive email or text messages related to your booking or order, including but not limited to: booking confirmations, appointment reminders, order and receipt details, ETAs, dress arrivals, future appointment scheduling, and customer care inquiries. These messages are part of the services you've requested and are sent automatically in connection with your appointment or purchase. Opting out of these messages may impact important information regarding your booking or order.

Marketing Communications Promotional emails and text messages (such as sales, new arrivals, and general marketing) are sent only to clients who have separately opted in — for example, by subscribing to our newsletter or providing consent in-store. You will not be automatically enrolled in marketing communications simply by booking an appointment.

Opting Out You can opt out of service or marketing communications at any time by email, direct contact with TMB, or by replying STOP to any text message. You can also reach us at (548) 855-0011. Message and data rates may apply.

Privacy

  • Any information regarding your client data is kept confidential within TMB.

  • We do not discuss purchase details with anyone other than the bride/client. If another party is paying for the dress or other products, a copy of the paper receipt will be provided. Requests for a detailed invoice are at the discretion of the bride/client.

6. Intellectual Property

All content on our website — including photographs, text, logos, and designs — is owned by The Modern Bride or used with permission from our designer partners and photographers, and is protected by Canadian copyright and trademark law.

You may not copy, reproduce, distribute, or use any content from our site for commercial purposes without our prior written consent. Designer gown photography remains the property of the respective designers and is used under license or with permission.

7. Third-Party Links

Our website may contain links to third-party websites (e.g., designer sites, social media). We are not responsible for the content, privacy practices, or terms of any third-party sites, and linking does not imply endorsement.

8. Limitation of Liability

To the fullest extent permitted by law, The Modern Bride is not liable for any indirect, incidental, or consequential damages arising from your use of our website, boutique visit, or purchased goods and services. Our total liability for any claim relating to our services is limited to the amount paid by you for the specific product or service giving rise to the claim.

Nothing in these Terms limits liability that cannot be excluded under applicable Ontario or Canadian law.

9. Disclaimer

Our website and its content are provided "as is" without warranties of any kind, express or implied. While we strive for accuracy, we do not guarantee that gown colours, fabrics, or availability shown on our website will be identical to what is available in-store, as designer inventory and production can vary.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of Ontario.

11. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date above reflects the most recent revision. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
